Terms of Service

1. Acceptance of Terms
By accessing or using cAIrView (“the Service”), you agree to be bound by these Terms of Service. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.
2. Description of Service
cAIrView is a subscription-based software service that collects call alert operational data from facility-installed client software, analyzes response time trends and alert patterns, generates monthly AI-narrated video summaries and written reports, and delivers reports via email and a secure web portal.
The Service processes operational metrics only — alert counts, response times, and location identifiers. It is not designed to process, store, or transmit Protected Health Information (PHI) as defined under HIPAA.
3. Subscriptions and Payment
- Access to cAIrView requires a paid subscription
- Subscription terms, pricing, and billing cycles are specified in your Service Order
- Subscriptions renew automatically unless cancelled in writing 30 days prior to renewal
- hss.llc reserves the right to suspend access for non-payment after 15 days notice
4. Customer Responsibilities
You agree to ensure the cAIrView client software is installed and maintained on authorized facility hardware, configure location and device names using non-identifying labels only (room numbers or unit names — never resident names or any PHI), designate authorized users, maintain credential confidentiality, and comply with all applicable laws including HIPAA.
5. Business Associate Agreement
If your organization is a HIPAA Covered Entity or Business Associate, you must execute a Business Associate Agreement (BAA) with hss.llc prior to using the Service. Use of the Service without an executed BAA where one is required is a material breach of these Terms.
6. Acceptable Use
You may not reverse engineer the Service, process PHI without an executed BAA, share login credentials between facilities without authorization, interfere with Service infrastructure, or use the Service for any unlawful purpose.
7. Data Ownership
You retain ownership of all operational data submitted to the Service. hss.llc retains processed reports and metrics for the duration of your subscription plus 90 days. Upon termination, you may request export of your report data within 30 days. hss.llc does not sell or share your facility data.
8. Limitation of Liability
hss.llc's total liability shall not exceed fees paid in the 3 months preceding the claim. hss.llc is not liable for indirect or consequential damages, third-party service outages, or decisions made based on report content. Reports are informational tools, not medical or legal advice.
9. Governing Law
These Terms are governed by the laws of the State of Illinois. Disputes shall be resolved in the courts of Cook County, Illinois.
